Can you sue a fired employee for a portion of their wages if they earned them using false academic credentials?

According to the Bureau of Labor statistics pay difference for someone with ';some college'; versus as bachelor's is 38% in the region and occupation in question. Their pay was set according to BLS prevailing wage for someone with the degree the employee claimed (in writing) to hold. They've recently been fired, but have found from their university that they merely attended some classes and did not earn this degree. Essentially, they bilked my company out of inflated wages based on fraudulent claims. 5 states, not including KY (where this is) have criminal penalties for this. Do you think at least some compensation could be awarded to the company for this, to account for what their pay would have been without the claims of false credentials?Can you sue a fired employee for a portion of their wages if they earned them using false academic credentials?

A court would award you the difference in the value of the work that was done v. what you contracted for. They will not award the difference in the wages as the court would have to speculate on whether the employee would have agreed to take the job at the lower wage. If you would have paid the same amount to someone with a degree and if you got the same quality and quantity of work that you contracted for, there are no damages. The fraud is grounds to terminate the contract, but in most cases there are no damages.
Did they do the same amount and quality of work as someone with the degree? If they did, why should they have to accept less pay just because they don't have some piece of paper. To most intelligent people, skills, experience, and quality of work should be more important than some piece of paper.
If there were criminal penalties, it would not be exercised by you, that's a state matter. You would not get your money back.

To be sure, the onus of responsibility resides w/ the employer to check these things ahead of time. It now looks as if you accepted him the way he was.

I am a SJ Sharks fan %26amp; there are a few employees who are fans too, so as you can guess there's alot of hockey talk in the workplace. She told me her decision is not negotiable. I told her I couldn't abide by it, so she showed me the door.

I would say no to the legal recourse. You said yourself that she emphatically told you she was tired of it. The first mistake was telling her that you found her request unreasonable it gave her just cause to let you go.

She may have wanted you out anyway, and as for things she told the temp agency they may have embellishments of the truth.

No, you don't have any legal recourse, and wouldn't even if you weren't a temp. The supervisor was within her rights to file you. She didn't even need a reason, like the talking about hockey.

The reinstatement of the 8 is really not a priority. At this point in time, the priority is to get down to the truth. There still isn't any clear evidence that Gonzales lied, but where there's smoke, there is certainly fire. And smoke detectors are beeping all over the White House!

ok i worked at this call centre for almost 2 years and then one day i used the internet on the computer when i wasn't suppose to and i got let home early buy a supervisor the next day when i came back to work i was working for an hour and the owner came to me and told me he needed to speak to me and then he spoke with me and asked me about the incident with the internet so i told him i am sorry and it won't happen again and he told me that he is going to decide if they want to keep me or not so they let me go again early as i know i am suppose to get minimum 3 hours pay i didn't talk about it as i needed my job and id isn't want to get fired so then 4 days later they call me and tell me to come back to work and there going to tell me there decision and i go there i wait for like 30 mins for them to talk to me and then at last the owner comes n asks me do you really know y i suspended you? i am like y he is like you;ve been doing criminal activity some thing about taking a credit card number from customers and doing fraud with them and stuff i had no clue what he was talking about but why suspend me for a different reason and then fire me for a differnet you know it is kinda fishy what can i do about this help me pleaseI got fired from a job for a false accusation what can i do?

I don't know what state you're in. Some states, including CA, are ';at-will'; states which means you can be fired for any reason or no reason. If you can prove you were fired because you are in one of the categories protected by the Constitution, such as race or religion, you may be able to do something about it. Otherwise, you are out of luck.
As Fern said, if you live in an “at will” state, your employer can fire you at will, as long as the decision to fire you is not discriminatory.

I don't think there is much you can do. Employers in most states don't even have to have a reason to fire you. Most states are what is called ';at will employment'; states. It means you can quit any time, and you can be fired any time.

The law protects certain classes of people from discrimination, but still allows for ';at will employment';.
Unless you have an employment contract, your employer can let you go for any reason, as long as its not ';unlawful.'; Unlawful means its based on race, religion, some cases age and so on. You case doesn't seem to fit, get another job....

Job harassed me about a payroll issue they made and forced me to sign false information or be fired can I sue?

I was recently informed that because I was put on a3 week part-time (temporary schedule) that I was supposed to miss a pay but because the documentation was submitted late I got paid when I shouldnt have(mind you I was told the day before my direct deposit). I was never made aware that I was going to miss a pay nor has proper documentation been given to me still that this is the case,and when I requested info I was told that if I didnt sign a letter saying I agree that I would be fired. My check was 944.00 and they are requiring me to pay them 1166.00. No one can explain it to me and they also dont know where my incentive pay is that I was supposed to recieve that was well over 250.00 dollars. I was forced to sign papers that I didnt feel were legitimate or lose my job is this cause for a lawsuit ?Job harassed me about a payroll issue they made and forced me to sign false information or be fired can I sue?
File a case against your employer to clarify the incident that you were made to sign papers you deemed were false with harassment. Under the labor laws, you should be notified of the offense you committed and be given due process to properly answer the charge.

I was fired from a child welfare agency . I was accused of not doing apartment checks in the transition living homes I work in. A female was found in one of the residents units on 9/12/2009 at 11:00 am. The resident when questioned stated the female enter on the over night shift where company is not allowed. I did not work on the 12th of September in which date the incident happened. My shift does not start until the 13th. I work 1am to 9am on Sunday and Monday's. When I tried to tell them this they would not listen. I beleive the real reason they fired me is because a water cooler was stolen, all staff members got written up for this and it said if it didn't show up by a certain date it would be deducted out of our pay checks (divided evenly). There was a staff meeting following the write up and when asked if we had any comments or questions I raised my hand and stated that I was not in aggreement with this money for the water cooler being taken out of my check because the thing came up missing during the week. I am a part time weekend worker. I work on Sunday and monday nigts from 1:00am to 9:00am. I was fired and they still took the money out of my check. you really dont undestand the meaning of hearsay..... if this person is accusing YOU of harassment and saying ';bad things to HER'; then she heard these things directly from YOU (true or not thats for the judge to decide.), if she heard these things from a third party then THEIR statement of THEM telling HER about what YOU said to THEM (the third party) would be hearsay.

Buyer contracts are not worth the paper they are printed on. In fact, the only people who will even look at them is the realtor associations. No judge in any court would consider it binding since those documents ALWAYS break several laws. We live under law and contracts must abide by those laws. The statement stated that my brother told him that his wife made a list of stuff to take and he would get it. The investigator asked about me and my brother said he acted alone. He was arrested and let his wife go. Nov 14 I was fired because the same employee came forward again and stated that I would let him on property while I worked security. Did you sign a contract that says you can not be fired for any cause? Most employees are ';at-will'; employees. This means that they can be fired for ANY reason except discriminatory reasons (racial,pregnant, etc). You might be able to go through the formal complaint process through your former job.

Also check into exactly what the other employee said or wrote. You might beable to bring a defamation suit. Defamation is a tort committed against the plaintiffs character or reputation by tanother persons false statements intentionally or negligently published (orally or in writing) to a 3rd person which statements hold the plaintiff up to ridicule, contempt, hatred, shame, or disgrace. This sounds like it would fit your situation. You would just have to see if a defamations suit is applicable when the false statement is made to an officer during their investigation. For ex. in NY a defamatory statement is qualifyable privileged (in other words the statement is allowed). BUT this privilege can if lost if you can prove that the defamatory statement was made with: malice (spite, ill will or meanness) or a high degree of awareness of its probable falsity aka constitutional malice.

You can also check and see if the detective can charge the person with 'false statement to a police officer'.

A couple days ago I got fired because my boss thinks I broke into the bar and stole alcohol. There are two other bartenders that work there and they just happen to have went to school with my boss. Note: for all you know there was no break in and there is no liquor stolen. This could all be an attempt on the part of your boss to bilk his insurance and at the same time fire you without having to pay benefits. Check to make sure he filled out a police report and if he did not accuse you then make sure the workforce people know that. Either he has evidence against you or he does not. I would think he does not. Fingerprints are not enough, nor is DNA. He needs video, or a witness to put you in the bar at the time of the crime. He needs you caught with the alcohol. I do not believe that God who is a God of mercy and love would get any pleasure out of anybody/anything suffering for eternity. You have to realize that interpretations and translations often get distorted through the years, it's my opinion that the word forever has different meanings. The Hebrew language has specific words that pinpoint the true meaning, unlike the English language. Some of the words for forever used in the Bible actually mean a specific amount of time set by God to accomplish His purpose. God is not constrained by time boundaries and limitations as we are being mortals. It's really hard to come to an understanding of what prophecy in the Bible is trying to say exactly. Even the clearest of the Old Testament prophecies were misinterpreted by even the best of the Jewish scholars as to their meaning, and I can't see why we should be any better at it these days than they were back then.

I've always been under the impression that the false prophet was the anti-Christ, but then again anyone who would lead others in a direction away from Christ would fit that description, so it's hard to say for sure.

As for me, I've given up trying to pin every prophecy with specifics, like names and dates. I imagine I'd only end up being incorrect in the end. And really more importantly, in the long run it doesn't really matter. No one is going to become a Christian because the anti-Christ turns out to be from McDonalds as opposed to the white house. When all this stuff is meant to happen it will, and after the fact we'll look at the prophecy and be able to say, ';oh... yeah, that makes sense.'; and move on with our lives. I don't know, maybe I'm just skipping to that last step early, but it just seems like an awful waste of time to me to try and figure these things out when we could be winning more people to Christ, meeting the basic needs of those around us, and ministering to our fellow Christians, helping to make them stronger in their faith so they can help others. Anyway, hope this helps.

In this situation, the best thing your friend can do is seek legal advice. You don't say where you are UK, USA etc. but I would imagine that dismissal without evidence of any misconduct would be challengable.

In this way, all of Satan’s earthly organization comes to an end. The “former heaven” of political rulership has passed away. Why, yes, the king over the locusts is called “the angel of the abyss”! (Revelation 9:11) So here we again observe Jehovah’s Chief Vindicator, the glorified Jesus Christ, in action. This archangel that cast Satan out of heaven, that judged Babylon the Great, and that disposed of “the kings of the earth and their armies” at Armageddon would surely not step aside to let a lesser angel deliver the masterstroke in abyssing Satan!—Revelation 12:7-9; 18:1, 2; 19:11-21.

When the great fiery-colored dragon was hurled down from heaven, he was spoken of as “the original serpent, the one called Devil and Satan, who is misleading the entire inhabited earth.” (Revelation 12:3, 9) Now, at the point of being seized and abyssed, he is described again in full as “the dragon, the original serpent, who is the Devil and Satan.” This infamous devourer, deceiver, slanderer, and opposer is chained and hurled “into the abyss,” which is closed and sealed off tightly, “that he might not mislead the nations anymore.” This abyssing of Satan is for a thousand years, during which time his influence on mankind will be no more than that of a prisoner in a deep dungeon. The angel of the abyss removes Satan completely from any contact with the Kingdom of righteousness. What a relief for mankind!

What happens to the demons? They too have been “reserved for judgment.” (2 Peter 2:4) Satan is called “Beelzebub the ruler of the demons.” (Luke 11:15, 18; Matthew 10:25) In view of their longtime collaboration with Satan, should not the same judgment be meted out to them? The abyss has long been an object of fear to those demons; on one occasion when Jesus confronted them, they “kept entreating him not to order them to go away into the abyss.” (Luke 8:31) But when Satan is abyssed, his angels will surely be hurled into the abyss with him. (Compare Isaiah 24:21, 22.) After the abyssing of Satan and his demons, the Thousand Year Reign of Jesus Christ can begin.

Will Satan and his demons be active while in the abyss? Well, remember the scarlet-colored, seven-headed wild beast that “was, but is not, and yet is about to ascend out of the abyss.” (Revelation 17:8) While in the abyss, it ‘was not.’ It was nonfunctioning, immobilized, to all intents and purposes dead. Likewise, speaking of Jesus, the apostle Paul said: “‘Who will descend into the abyss?’ that is, to bring Christ up from the dead.” (Romans 10:7) While in that abyss, Jesus was dead. It is reasonable to conclude, then, that Satan and his demons will be in a state of deathlike inactivity for the thousand years of their abyssing. What good tidings for lovers of righteousness!

It is a strange thing in the testimony of scripture to know when a period begins or ends. Jesus said that the people of this age will not pass away until all of these things come to pass. He was speaking about the period of time when generations of man are born upon the earth.

Also, the Book of Revelations is very highly symbolic. The Beast is said to be the body of the followers of satan. That body is made up of those who perform the rites of satan. The more base that body becomes, the more terrible the elements are upon it. Therefore, one can only beg people to avoid occultic rites and ritualism.

St. Peter says that we must be submitted to a trial like gold tested in fire, so that we can be purified and stand before the Lord who is perfect in every measure. But as to those who live according to the flesh and refuse his every mercy, to them has been reserved the everlasting fires of hell.

We do not know for instance if the 1000 years is a chronologous period or portions of time. For example, the Third Reich lasted for 12 years. And one can read the Book of Revelations and see that the symbolic sum and variations of the parts happen many times and in many places. If the Lord had not shortened this period it says, no man would remain. So that he has made these periods for our justification in grace and in mercy, with a trial with which he gives to each man a way out, or a path to Him.

One of these paths is the 'Fiat' of Mary, or her relentless yes to the plan of God. The Holy Mother is shown in Rev. 12 as the ';woman clothed with the sun.'; When we allow ourselves to be covered by the mantle of Mary, no fierce heat nor terror nor falsehood can overcome us. Because she is full of grace, as the angel proclaimed of her. God is tender in his mercies as she is our oasis in the time of distress and at the ';hour of death.';

By our Baptism in water and the spirit, we proclaim that we do believe in the Father, the Son and the Holy Spirit and that we do reject satan and all of his works, his pomps and his false promises. To those that return to the contiual baths of his mercies, and wash their robes in the Blood of the Lamb, there is no fear in them of the punishment of the wicked, nor the distress of the worldly minded.

'For in these I will place my Spirit, that they do rightly, and come to a good end, for I myself Am the Lord, who speaks through the hearts of all believers.' If this Word is in you, then you too shall come to the fullness of the saving knowledge of Jesus Christ.

Since the term Beast is used to describe both beings working with Good forces, (The Four Beasts), and Bad forces. I think they might be powers of a more elemental nature. Perhaps even beings we have created ourselves.

When they are destroyed, or put in a position where destruction is inevitable, is UNKNOWN. But it will be after 1000 years of

peace, and evil again roaming the Earth for a time. According to the Book you refer to.
The Beast as described in the Book of Rev., is a beast system.

It will be headed up by satan himself when he is kicked out of Heaven by Michael at a specially appointed time. You have probably heard about the 7 year period - split up to 3 1/2 years plus 3 1/2 years? Well, actually you will find in Rev 9 that it was shortened to a five-month period. Thats all the time satan will actually have to fully run the beast system, which is a one-world government, one common religion for all.

When Christ returns (which will be AFTER this event) this earth age will come to a close, and there will be a 1000 year period of teaching and disipline. It is only after this period that the great judgement will happen - so everyone who did not have a chance to learn the truth while in the flesh, will still have that 1000 yr. period to learn the truth - nobody is going into the lake of fire without having a clear understanding of the truth, and be given every opportunity to avoid death of the soul. During this period, satan will be locked away, so he will not have any ability to interfere with anyone. But, after the period is over, he will be let loose for just a small amount of time so that anybody who wants to follow him can do it - and they will follow satan into the lake of fire, which is to say, satan will be turned to ashes from within.

There is no such hell where we will see people frying like bacon for an eternity - its just not written. Its only an idiom (a saying) that their smoke will rise up forever and ever. smoke does that.

I've been at the company for 4yrs before this guy come in, I had 4 wright ups.In the past yr he's wrighten me 14 times. After I've signed the wright ups he's added to them and making up poor job performance just to wright me up. I've talked to the owner and he told me that me job performance was fine and not to worry about my job,but my supervisor continued to wright me up and has the company believing that I'm a poor employee. I know that I've done nothing wrong to deserve this treatment. All the contractors that I work with always tell me that They really appreciate the job I do for them.My boss is looking to fire me,and making up many false job performance reports, Do i have any legal action?
You have to learn the art of war.

Do your best to sway people's opinions. If you're positive then be MORE positive. If you're cheerful then be MORE cheerful. Eventually the company will see him in a different light.

You should look for another job and quit before he fire you! because after all, being fired is worse then quiting on your own decision and it won't effect your job history. find another job quickly.
Talk to the company owner, calmly explain the situation in objective terms, and inform him that if the situation continues you will have no choice but to seek legal advice. If he does not do anything about it, see a lawyer.

You can't expect to get authoritative advice here. Even what I suggest may not be the best approach.
Generally signing a write up simply means that you have been advised of being reprimanded. It does not mean that you agree with the write up. Therefore it matters not a lot what the supervisor added after you signed.

However, my advice to all employees is this -- always ask for a copy of the signed write up. Then you have one without the added/false information for your files. Plus if you ever want to prove harrassment, you have copies of all the write ups to show how extreme the supervisor was.

I can't imagine having 14 write-ups and still having a job. Makes him look like a bad supervisor.

I would start looking for that next job, just in case. If the owner hasn't stopped the supervisor's behavior by now, chances are he won't.
I havent read the other contributors comments but if you are correct then I believe you have a case of harrassment.

Look to see if you have either a dignity at work or harrassment policy. Meanwhile gather your written reviews going back since you started work and begin to keep and collate evidence.

Also refer to your capability policies which cover poor performance .......be prepared for what their course of action might be, anticipate it, and have the evidence waiting......

You do not have to sign the write ups. The next time he puts one in front of you just turn it over and on the back write really big ';REFUSE TO SIGN'; and then initial it only. This will basically get you a grievance meeting with you and him and his superior. At which time you can explain how you are being singled out and previous write ups were altered after you signed them.
You always have legal rights no matter what document you sign. You don't have to sign it but not signing doesn't mean that the write up doesn't stand. You need to accurately document conversations that the two of you have and try to talk to this person with a neutral coworker there to take notes.

14 write ups is a lot. It almost sounds like harassment. When people write their employees up like that, they are trying to manage you out of the company--- get you to quit so they don't have to pay unemployment to you. Has your supervisor put together a plan and commitment agreement for you. Are you two having follow up meetings to help you better yourself as an employee in his eyes? Do you think this is harassment? Does he overwork you, treat you differently, says mean things in front of other workers, is his behavior affecting your work performance?

Document these issues, continue to work hard and do your best and if you answered yes to the above questions, go to his boss-- all companies have ';open door policies';-- no one deserves be harassed.

First off, the President has a cabinet. That is, people (usually referred to as Secretaries) who head up different departments in the executive branch. Each department, Dept of Agriculture, Dept of Defense, State Dept, Dept of Transportation, each have various departments within their own department, with various responsibilities. These department heads are responsible for those under them, have a greater understanding and working relationship of federal employees, and would be the one to determine who should be hired and/or fired. The President is generally far removed from them, and that is the purpose for the hierarchy.

Like the Secretary of Transportation has has the FAA (Federal Aviation Administration), FMCSA (Federal Motor Carriers Safety Administration) etc. Each of those sub divisions has smaller divisions within them. So the President may order the firing of bureaucrats, but does not directly fire them. In fact in 1981, President Reagan fired, or ordered the firing by the FAA of 12,000 air traffic controllers who were striking and refused to return to work, on Reagan's orders.

Fact is, the President can fire, or at least order the replacement of workers in the private sector, if national security is threatened. Airline pilots, truck drivers working in the private sector, can be imprisoned, fined, and replaced, if say a strike is called and the welfare, security, safety, or economy of the nation is in jeopardy, they are ordered back to work, but refuse. The President orders the firing, but the department heads would actually carry it out. .

The President cannot fire those elected to positions or offices. The U.S. House can impeach them, the Senate place them on trial and remove them, including the President.

So the President CAN already fire anyone throughout the bureaucracy, directly or through chain of command. He would tell his Secretary of that particular dept, who in turn would tell one of the dept heads to tell those under them, until it got down to the supervisor, or head of the person the President wants fired. And yes, he should have the power, in the event the nations security is in danger.

Christ does not have to come back and teach that the trinity and an eternally burring 'hell' are false for any true Bible student to know that they are patently false and of pagan/catholic origins. And yes they will be held responsible for all of their false teachings and for the finial dispensations of those whom they have lied to and deceived. I would not want to be in their shoes.
Jesus spoke more of the dangers of hell than anything. So if someone claimed to be Christ saying there was no hell, I wouldn't believe them. Christ also proved His divinity by raising from the grave and promised His return. So when He returns again only proves He is divine. The Bible says there is only one true God. So His return would also prove the trinity.
I believe we will be held responsible if we have a chance to help someone come to a saving knowledge of Jesus Christ: and we don't follow through on doing so. One thing we should guard against (IMO) is focusing on an issue that is not important (in the sense that it will keep someone from trusting Christ) instead of telling them about the saving GRACE of Jesus. We shouldn't get caught up in arguments over things that will not decide eternity.

Christians are certainly not perfect but the difference between them and you, is that they are forgiven, therefore they can enter eternity but you won't.

So, when Jesus Christ returns in a time of His choosing, for you, it probably, won't make any difference except that everyone else will be terror struck and God tells us that the people of this earth will believe a big lie by some world leader to explain the millions who have disappeared totally off the planet, from every race, tribe and tongue, even graves will be opened and bodies gone... and they will all have been Christians, redeemed by the One who died on the Cross and was resurrected on the 3rd day and is now seated at the right hand of God the Father. The One to whom ALL hearts are open and every desire known..the One who has always known His own from before the earth began..the One who knows who will spend eternity with Him and the rest ?

Note it says 'let us' and 'in our image/likeness' these are plural so God was not alone before creation.

This one also says Jesus was with God in the beginning before creation even was. Jesus is the word of God and become flesh.

this proves Jesus is God in the flesh and Jesus said he will baptize us with the Holy Spirit and fire. The Holy spirit lives in us and teaches and guides us.

We have the spirit of God in us as the Holy Spirit.

God is: mind(God), body(Jesus) and soul(Holy Spirit).

Man is: mind, body and soul.

Each of these three make one complete being.

We are made in God's image and likeness.
